Shortly after, on June 4, 2024, the Ministry of Commerce enacted the accompanying Patent Rules (PTR) through Notification No. 43/2024, providing detailed procedures for patent registration and enforcement.

Patent Protection System in Myanmar

The new law recognizes and provides protection for two types of patents:

• Invention Patents: Must meet the requirements of novelty, inventive step, and industrial applicability.

• Petty Patents: Must meet the requirements of novelty and industrial applicability.

Myanmar applies the "first-to-file" principle, meaning the first applicant to file a patent application will be granted the rights.

The competent authority for receiving and examining applications is the Intellectual Property Department (IPD) of Myanmar.

Filing Language and Requirements

Patent applications may be submitted in Myanmar or English. However, a notarized translation may be requested by the IPD if deemed necessary.

Required application documents include:

• Completed Application Form PT/UM-1

• Patent specification (title, technical field, detailed description, etc.)

• Abstract of the invention

• Patent claims

• Drawings (if any), with brief explanations

• Inventor's name, nationality, and details

• Inventor’s declaration or consent

• Applicant’s legal information

• Details of the local representative in Myanmar

• Priority document (if claiming priority under the Paris Convention)
