Step 1: Preliminary search and consultation
Before filing, a preliminary search is conducted to assess the patentability of the invention/utility solution and avoid duplication or infringement of existing rights.
Step 2: Drafting the specification and post-search advice
We support drafting a clear and complete specification that complies with legal requirements.
Step 3: Filing the application with IP Vietnam
The application includes: application form, specification, drawings (if any), and relevant documents.
Step 4: Formality examination
Within 1–2 months, IP Vietnam conducts a formality examination to verify the validity of the application.
Step 5: Substantive examination
This occurs within approximately 18 months from the publication date (or earlier if an early examination is requested). IP Vietnam evaluates novelty, inventive step, and industrial applicability.
Step 6: Grant fee payment
If the application is accepted, the applicant will receive a Notice and proceed with payment of the grant fee.
